Opt-In Pro is CAN-SPAM Compliant. What are the main points of Can-SPAM? 

  • Requires the inclusion of a valid physical postal address within every commercial email 

  • Outlaws the use of false or misleading headers 

  • Outlaws the use of deceptive subject lines 

  • Requires a clear and conspicuous opt-out mechanism within every commercial email 

The FTC (Federal Trade Commission) will be strict in their enforcement of the CAN-SPAM law and violators may be subject to “cease and desist” orders or penalties up to $11,000 per violation. Criminal prosecution is also possible in the case of egregious offenders, which can result in penalties such as fines, forfeiture of proceeds and equipment. 

The worst offenders will also be subject to prison time. Legitimate email marketers that use Opt-In Pro will likely not have to worry about the consequences mentioned above, however, the significance of the law is very important to adhere to for everyone. 

Software and Service through which software is accessed may only be used for opt-in lists; the recipients must have voluntarily signed up for your list.

Using Software to send out messages to email addresses which you have purchased, "harvested"/collected from the Internet or otherwise obtained without the consent of the recipient is a violation of our policies, and we reserve the right to take legal action against anyone found doing so.

If KowaBunga! Technologies receives one (1) or more SPAM complaint, your account will be immediately be suspended while KowaBunga! Technologies investigates the complaint(s).

If we find that you did indeed send an unsolicited mailing - your account will be immediately terminated.

If you believe that you have received an unsolicited mailing from one of our users - please contact us at abuse@kowabunga.net. Please be assured that we will take immediate and serious action against any and all offenders of this policy. Please understand, we can only control those people who are using our software and service - we cannot help you with SPAM you have received from anyone who is not using our software and service...
